Restraining Order Sought Against Elijah Dukes

Elijah Dukes is in trouble again. The St. Petersburg Times reports in this morning's editions that Elijah Dukes' estranged wife has sought a restraining order against her husband. The request for the order comes after what she says are threats against her life in numerous forms over the last several weeks. The matter has been referred to a court proceeding scheduled for May 30th, and Dukes could face criminal charges if the allegations are substantiated.  

According to NiShea Gilbert, Dukes not only sent her a text message that included an image of a handgun, but he also left a voice mail message on her phone. The voice mail contained an individual, allegedly Dukes, saying "You dead, dawg" and "I ain't even bullshitting. Your kids, too." Dukes declined to make any comment of substance on the matter when approached, and the Rays remained non-committal and mostly silent on the matter, taking a wait and see approach.

This is not the first time Gilbert has sought a restraining order against Dukes. She sought one several weeks ago that was dismissed due to her absence at a scheduled court hearing on the matter. The latest request for a restraining order was filed last Thursday. A voice left on Gilbert's answering machine that she attributes to Dukes contains the word "dawg" five times, some variation of "fuck" three times, and the word "nigger" twice. It was stated in a mostly threatening manner, was extremely repetitive, and reads as follows :

"Hey, dawg. It's on, dawg. You dead, dawg. I ain't even bullshitting. Your kids too, dawg. It don't even matter to me who is in the car with you. Nigger, all I know is, nigger, when I see your motherfucking ass riding, dawg, it's on. As a matter of fact, I'm coming to your motherfucking house."

Gilbert did not pursue criminal charges against Dukes, and the restraining order is the only legal action she has attempted to make with regards to the matter. Dukes has been in anger management and since being suspended for the final month of the 2006 season with Durham, he has been relatively well-behaved. A pot bust in a car this January is the only incident to be spoken of. Dukes and Gilbert have been married for almost 15 months; they have two children, both out of wedlock. Dukes has had three other children by three different women. Gilbert had filed for divorce once before in the marriage, and says that this time she will consummate it.

The main incident to be spoken of in this matter occurred at Gilbert's school, however. On April 30th, Dukes allegedly barged into Gilbert's classroom during her lunch period. He reportedly began threatening her and lunging at her desk. Gilbert and another staff member then proceeded to the front office of the school with another faculty member when Dukes left the room. The resident School Resource Officer calmed him down and escorted him off the campus.

This incident is obviously not the first to have plagued Dukes throughout his troubled career. He has had numerous arrests since his youth for assault and drug charges, among other things, and was transferred throughout numerous high schools for behavioral problems. If upheld, this restraining order would be the second one Gilbert has taken out against Dukes. One other restraining order was filed against the Rays outfielder by Carla Bryant in October 2005, both ordered Dukes to stay away from the complainant for one year. Dukes and Gilbert have had a long string of domestic disputes during their troubled relationship, which includes four summonses to his residence by police. He has been accused of, among other things, throwing a remote control at her, threatening her, throwing a glass candy bowl at her, hitting her with a soda can, and ripping a phone cord out of the wall as Gilbert attempted to call police. Conversely, Gilbert was arrested last year, accused of scratching her husband's back in another dispute. Dukes has received one related probation for a domestic quarrel back in 2005.

It's that this site is suited towards the general audience and they shouldn't need to be looking over their shoulder at work or anything because of the language.

Rays Nation is right, the "er" version of the word is a horrible word that shouldn't be in anyone's vocabulary. Noone besides Richard Pryor and Samuel L. Jackson have used that word without getting "Michael Richards"-ed.

Why do we need a translation of what was said anyways, we all grew up watching "Wheel of Fortune".

Regardless, there are no excuses for this type of behavior.  Myers should have been punished.  Dukes, if this is true, should be cut.  Might as well get it over with because you won't be able to rely on him in the future.

And I guess this means Rocco isn't getting traded, unless Upton is really going to convert to CF.

Dukes' wife posted a message on the online St. Pete Times article saying

"And for all of you that have comments to say. Only my kids and myself know what we have been through. And I am happy he has moved on. Only thing he can do for me is take care of his kids. And I am a very truthful person."

She got some heat from a couple of posters on there and after reading her comments in the article something just doesn't strike me right about her either.  No person deserves to go through what she is accusing Elijah of doing, but with his short fuse and her knowing better than anyone else how to push his buttons she probably could have avoided this entirely.

I'm by no means saying it's right, but with Elijah she may have fueled the fire that led to this and is now using it to her advantage.  She may be telling the truth about what happened, but with a few different things that she may have conveniently omitted.

I guess what I'm trying to say is that we shouldn't throw Dukes to the wolves because we don't know the whole story.

Sorry, that just sounds too similar to the "she was asking for it" rape defense.

As for the situation, no I don't know anything. If Dukes committed these acts, and they are listed truthfully, he needs to be gone. I grant you that there could be omissions and some of it may not be truthful at all, but that is for the system to decide.

Eh... Kind of, but not really.  To relate it to you a little better Patrick, if I type "Moving a three game series against the Rangers to Orlando is a good idea!!!" I know that you're going to post something telling me you disagree.  Then, I could keep going and going (Orlando = Mission Accomplished!!) just for the sake of seeing how far I can take you.

I know what the consequences of my posts on this subject will bring from you, but I could have avoided them if I would have just let it alone because at the end of the day it just really isn't that important anyways.

While my posts are no where near as serious as domestic violence or rape, women do not always tell the truth in cases with high profile men or may have put themselves in a situation (stripping for the Duke Lacrosse team) to where their exaggerated story is believable in order to gain leverage for their own personal gain.

Now if she is being honest, then Dukes deserves to be thrown in jail for a long time but I will remain skeptical until he's proven guilty.

Of course you can't be sure of the truth value of her remarks, hence my not advocating his dismissal. However there is a good chance Dukes did something wrong, and there probably is enough evidence to sustain an indictment. Whether one will be brought, who knows.

I don't think she's going to get the police involved  because she has too much to lose from Dukes going to jail.  With him in prison she'll get no child support/alimony but she still may receive the threats that she says Elijah has been punishing her with.  I am skeptical mostly because she went to the media and not the authorities, but his profile does have something to do with it as well.  If she was truly scared for the lives of her children and herself as well he'd probably be in jail right now.

A restraining order is only as good as the person you're trying to restrain.  A piece of paper is nowhere near as effective as steel bars and brick walls.  This is why I said that if he did indeed do what she alleges, then he deserves to go to jail.  But if she's not willing to do the right thing then she has no right to complain to anyone about something he does in the future, because nobody really knows to what extremes Elijah is capable of doing and she's gambling with the lives of her family and that makes her wrong.

The "indictment" angle doesn't exist. Weither he did what he's accused of or not she didn't go to the police for protection, she went to the St. Pete times. Everything about this screams that Dukes is a deadbeat dad (certainly not the first in MLB history) and this is her way of getting deserved child-support

I just can't believe people are questioning this woman. Read the police report from the school incident. Look at the phone message he left. Look at the restraining orders, including the one from the previous mother of his children.

And I applaud her for talking to the media. She went to court, she's called the police, and yea, now she's going to the papers. Instead of just letting this go and letting a public figure fool us all into buying his t-shirts, she's showing us what we have here in centerfield. Instead of fighting this on her own, she's made the Devil Rays and MLB and all of us fans, demand he stop.

You're absolutely right about the way my post came off, but that wasn't what I was going for. I'm kind of just feeling out ways it might not be true, to be quite honest.

Why didn't she go to the police about the death threat though? Surely that's a criminal offense, and one I would want the authorities to handle in an extremely quick manner. They would certainly respond given all of the past run ins Dukes has had with the law.

I agree with you Patrick. No one deserves to go through that, no matter what. She may know what how to push his buttons, but those buttons can change on the fly. Anything could have set him off. It doesn't matter what it was, it may not have been avoidable and probably wasn't.

Its one of a woman's biggest fears to be attacked/threatened like that. I really hope that the Rays do something about this. It doesn't have to be cutting him necessarily, but maybe anger management or something.

Adios Mr. Dukes. The last thing this organization needs is to become the Portland Trailblazers of MLB.

The incident at the school should disturb everyone. There's no question it happened. It's in the police report. It's not just her word against his. The phone message is him. This guy has no idea how to behave. He sure as heck shouldn't be representing this baseball team, or this region.

I don't get people here cautioning others about not jumping on Dukes and instead are questioning the woman. The man had to be escorted off of school property by the police. Hey kids, forget having Kaz come to your class, Elijah's on his way, and he's coming to kill your teacher. Nice promotion in the making.

This guys talent has given him so many second chances and yet he behaves like this? It's time this organization make a big statement, one that goes beyond the need for a power bat in the line up.

The beat writers have to live with this team day in and day out. It is the casual, more opinionated radio hosts and TV anchors that really represent the core of the problem.

Spectacular display of objective journalism, objective journalism that had J.P. Peterson referring to Dukes and Young as "high school punks" as well as "jerks". He also rhetorically asked if fans are happy about the team's future. He then goes off and talks about the Rays needing to trade them and to "get them outta here", and suggests suspending both Dukes and Young.

I seem to remember the Tribune/Ch. 8 being lest "aghast" when the Bucs signed Darrell Russell as well as when Michael Pittman went through his legal troubles. Clearly no conflict of interest affecting their editorial judgement.

Quite frankly hold Dukes in a similar regard, but I don't appreciate Peterson presenting his slanted piece as journalism, nor do I appreciate the cracks at the team and, for some reason, Delmon Young.

The content (as far and the words used) in Duke's message to his wife are irrellevant.  What is important is that you have a grown man threatening the life of a woman and his own children.  I couldn't care less how many times he used the "N" word or the "F" word.  He is threatening to kill his own kids.  I happen to have direct knowlege of this situation in that my wife teaches at the school where Duke's estranged wife works.  She witnessed two weeks ago when Dukes showed up at the school looking for DiShea.  DeShea locked the classroom door and Dukes spent several minutes banging on the door and kicking it yelling that "I am gonna beat your ass!".  The police finally arrived and escorted him from the school.  Dukes has had a tough life, but he has also gotten a free ride on a lot of things normal people would be in jail for just because he it a talented baseball player.  Every time the Devil Rays told DiShea not to have him arrested because it would "ruin his carreer" and she listened to them, it enboldened Dukes until now he seems to believe he can do anything and get away with it.  My wife told me that a few days ago Dukes text messaged a picture of a gun to DiShea with a message that he was going to kill her.  Now I do not believe that such behavior is hereditary, but given his background DiShea would be a fool not to take him seriously.

And for those of you idiots out there thinking the wife is just making these things up for leverage in the divorce.  Think about this.  If Dukes is cut and jailed he is worth much less to her than if she had just kept her mouth shut and let him keep collecting those fat paychecks from the Devil Rays.  DiShea stood to gain much more by this not becoming public.  This man is unstable and needs intensive psychiatric help to deal with his anger and violence issues before he hurts or kills someone.

There are legal ways to get out of that
At $382,000 a year, you can afford an attorney. And if you have kids by your marriage as Dukes and Gilbert do, having a divorce lawyer is required.

And once again "requested $28,000", that can be dealt with.

Listen, I never for a moment thought that this women was clean and had nothing to hide. I'm not that naive. However the actions Dukes took are unacceptable, especially so with his past. If anything, this new evidence adds credence to Dukes have sent the text message and having left the voice mail, because he now has motive.

This reinforces my prior comments about her making the situation worse for herself.  I still think Dukes should go to jail, but what did she expect would happen if she is taking all his money without him knowing.

Let's say he went to Best Buy to purchase a new HDTV with the extra money he's now making with his major league contract.  He tries to put it on his debit card after bragging about him being a DevilRay and being "Elijah Dukes" and his card gets declined.  He goes to his bank to find out what happened and sees all the money is gone.  The question is, if this was a situation I proposed two months ago what would have expected Elijah to do given his anger issues?

Let's get one thing straight
There is no proof that Gilbert cleaned out his banking account, the only information we have suggesting that is a quote from Dukes' mother, ya know, the one who bought fake crack that resulted in Elijah Dukes Sr. shooting the dealer? We're not exactly dealing with two people of great credibility.

From the Tampa Tribune:

Dukes' mother, Phyllis, said that incident was triggered by Nishea Dukes' withdrawal of thousands of dollars from a bank account. She later returned the money, Phyllis Dukes said, but not until the pair had a fight at Tropicana Field.

NiShea Dukes disputed that story.

"I'm not going to feed into that," she said in a text message to The Tampa Tribune. "How can I steal money when we [are] married with two kids? And on a joint account?"

It's the ballplayer's wife against his mother, I see no reason that we should lead any more credence to the mother than we do Gilbert. Perhaps even more trust should be placed with Gilbert because she is right, you don't just withdraw $30,000 from a joint account.

Even if Dukes was stupid enough to keep putting his money into a joint account and NiShea did empty it, it does not excuse his going to the school and threatening her or thraetening the kids.  Dukes is a punk and a thug and needs to be committed until he gets his head on straight.

The amount of money he is paying is not relevant, shelling out bucks doesn't make you a good father or a good person.  He threatened to kill not only NiShea, but the kids too, his own kids.  All the money in the world can't cover for that.

She's not such a clean, good person herself apparently, and obviously money is playing a role for her more so than some would have you believe.

Dukes shouldn't have said those things, but if they were in a heat of the moment thing after finding out she took all his money I can excuse saying somethings, other than the 'your kids too' since they aer his kids.

Oh and you're right, shame on Elijah for having a joint account, with his wife, what a dumbass for trusting his wife with their money.

Yes, hes is a dumbass, they are separated and she has a restraining order against him.  Anyone with a brain pain bigger than a a walnut would know its over and get another bank account.  Oh, by the way, its legally impossible for DiShea to take "all his money" because in Florida the minute he puts it in a joint account it becomes their money.

And yes, maybe if this is a regular person with no history of violence you might forgive the words said in the heat of the moment.  But Dukes is not a regular person, he has a long history of violence which stretches back to when he was very young.  He has shown an inability to control his temper and a willingness to act against anyone, including a woman, if he feels wronged.  Dukes is nothing more than a bully and a punk and needs to be forced into intensive counseling before he winds up in prison and DiShea and the kids wind up on a slab.

There is no excuse, people have been making excuses for Dukes for years, moving him from one high school to the next for disciplinary issues just so he could graduate and avoid detention, the numerous people talked out of pressing assault charges until he finally got a 30 day slap on the wrist in Durham, the number of people connected to the Rays who have "unofficially" encouraged DiShea not to go public so his carreer wouldn't be damaged.  It is time for people to stop making excuses for this punk and make him face the full extent of consequences for his actions.  And the first consequence should be that he shouldn't be allowed to put on a baaseball uniform again until this is resolved and he gets the mental help he needs.

He married the woman
To get out of paying child support. This obviously wasn't a relationship built upon love, the woman had filed for divorce once before, and he continually screwed other women. This isn't "wife" in the normal sense of the word, the trust that relationship usually conveys simply was not there in the first place.

R.J. Anderson, please at least try to get your facts straight.  NiShea filed for a restraining order the first time almost a year ago.  She has been in the process of trying to get another one but "unofficially" many connected to the Rays have been trying to convince her not to because it would "ruin his career." And NiShea listened top them right up until Dukes showed up at the Middle School acting like a maniac, the text message threatening both her and the kids with a picture of a gun was the last straw.  NiShea decided if the Rays were not going to be able to control him she had to go public.  

Anderson, why don't you and the rest of the pathetic Dukes apologists spend half as much time investigating and getting your facts right as you do defending this thug.  The shame of it is that if he was batting .201 and a utility player, most of you morons defending him wouldn't have thought twice about seeing him cut.  You people are the reason why athletes today walk around with the feeling the rules don't apply to them.  They know that no matter what, as long as they are good, people will always try to defend them.  What's worse is the way you idiots take their side and then try to deny you are doing it when you get called on it.  Dukes is obviously stupid, but at least he's honest about it, what he does is out there for everyone to see.  You people hover around the edges claiming there are "two sides" and insinuating that NiShea is just as at fault or that she is somehow manipulating this to extort money, you are pathetic and dishonest.  You are the kind of people that make it possible for abusive husbands to stay out of jail and sometimes kill their estranged wives.  And then you'll shake your heads with everyone else and wonder how it could have happened.  You defenders of this punk Dukes are the reason NiShea went public, so that no matter what, the information is out there now and the likelyhood of Dukes being able to harm her is much less with this much publicity.

Color me 1/2 pathetic and 1/2 dishonest.  Again, I firmly believe Dukes should go to jail for what he's done but NiShea is an instigator and a hypocrite.  I've read her interviews and what Dukes has done along the way (see three other kids with three other women, domestic violence) and if she was truly living in fear she should have tried to get him placed behind bars.

The money she is asking for is nearly 100% of Dukes monthly salary which she would not be able to get if he was in jail.  As a teacher she can make enough money to support both herself and her two children if Elijah is in jail and unable to pay support and alimony.  She obviously feels that living in fear for her and her kids' lives is compensated by $28,000 per month.  That's just flat out BS.

In defense of R.J. you took his post out of context and he was referring to the most recent incident not last years.  Jake, Patrick, and RJ could pretty much write a day by day time-line on the team on everyone from the peanut vendors to Stu himself over the past five years.

There is a court of law where you resolve those issues. Gilbert only requested that the sum of $28,000 be extracted, it wasn't consummated. If you want to contest that, you do it in a court of law, not a public school. There is no defending that, and it is proof once again that Dukes hasn't got his head on straight and probably never will.

Dukes didn't go to the school over the requested amount, he went because she withdrew the money from his account.  And again, I'm not defending Dukes in any way, I just don't trust either one of them and I do not care for the way either one is handling themselves.

That hasn't been proven in the remotest sense. The only source you have for that is Dukes' mother. It has been denied by his girlfriend. Neither has credibility to the point where you can take their word, however since it is a joint account I am more likely to believe Gilbert. You don't just withdraw 30 grand from a joint account.

It's a "joint account" for a reason
First of all, there is no reason to believe that this transaction actually occurred. We are relying on Dukes' mother for this info.

Secondly, joint accounts are just that; joint. They usually require some sort of protection against a withdrawal like this, such as the consent of both parties.
